Terms of Service

By accessing or using MyTimeKeep ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

1. Accounts

When you create an account, you must provide accurate and complete information. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Each company account is managed by an administrator who is responsible for managing employee access and data within their organization.

2. Subscriptions and Payments

• Some features of the Service require a paid subscription.
• Subscriptions are billed monthly via Stripe. You agree to pay all fees associated with your selected plan.
• Free trials may be offered. If you do not select a paid plan before the trial ends, access for employees will be restricted.
• You may upgrade, downgrade, or cancel your subscription at any time through the Invoicing page.
• Refunds are provided on a prorated basis when downgrading or cancelling.

3. Data Processing

By using the Service, you acknowledge that:

• You (the company) act as the data controller for employee data you enter into the system.
• MyTimeKeep acts as a data processor and processes data only as instructed by you and as described in our Privacy Policy.
• You are responsible for obtaining appropriate consent from your employees before entering their personal data into the Service.
• Each company's data is stored in a separate, isolated database.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other accounts or systems
• Upload malicious code or interfere with the Service's operation
• Resell or redistribute the Service without written permission
• Use the Service to store data unrelated to employee time and leave management

5. Intellectual Property

The Service, its original content, features, and functionality are owned by MyTimeKeep and are protected by intellectual property laws. Your data remains yours — we claim no ownership over the data you enter into the Service.

6. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We will attempt to provide advance notice of planned maintenance.

7. Account Termination

• You may terminate your account at any time by contacting us or using the cancellation features in the Service.
• We may suspend or terminate accounts that violate these Terms.
• Upon termination, your database, user data, and all associated records will be permanently deleted.

8. Limitation of Liability

To the maximum extent permitted by law, MyTimeKeep shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use or inability to use the Service.

9. Indemnification

You agree to indemnify and hold harmless MyTimeKeep and its operators from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Data Protection Agreement

By creating an account, you enter into a Data Processing Agreement (DPA) with MyTimeKeep. As a data controller, you acknowledge that MyTimeKeep processes personal data on your behalf in accordance with our Privacy Policy and applicable data protection regulations including GDPR.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We will notify account administrators of material changes via email.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MyTimeKeep operates, without regard to its conflict of law provisions.
